1. Our agreement
These Terms of Service govern access to Supaviral Ads, including its website, creative workspace, AI image and video generation, project tools, and related services (the Services). Supaviral, we, us, and our refer to the operator identified below. You means the person using the Services or the organization they are authorized to represent.
The operator’s legal name, business address, country, and monitored legal contact email are awaiting confirmation. These documents are drafts until those details are completed.
By creating an account, purchasing a plan, or using the Services after being presented with these Terms, you agree to them. If you do not agree, do not use the Services. If you act for an organization, you confirm that you have authority to bind it. Our Privacy Policy explains personal information processing; it is not a waiver of your privacy rights or a substitute for consent required by law.
Any separately signed agreement takes priority where it expressly conflicts with these Terms. Mandatory rights under applicable law, including consumer guarantees, continue to apply.
2. Eligibility and accounts
You must be at least 18 and legally able to enter this agreement. Provide accurate account information, keep it current, secure your credentials, and promptly report suspected unauthorized use. You are responsible for activity you authorize and for the people you permit to use your organization’s workspace.
Do not sell or transfer account access, share credentials to bypass plan limits, or create accounts to evade restrictions. Use any available team-access features rather than sharing passwords. Third-party sign-in does not grant us access beyond the permissions you authorize, and disconnecting a provider does not automatically cancel your subscription.
3. The Services and AI limitations
Supaviral provides tools to organize creative materials and request generated images, videos, and prompt assistance through supported third-party models. Features, processing times, model availability, resolutions, and usage limits depend on your plan and provider capacity. We may update the Services to improve them, meet legal requirements, or respond to provider changes.
AI output can be inaccurate, incomplete, offensive, distorted, or similar to someone else’s work. Text, products, faces, voices, facts, and claims may be represented incorrectly. Outputs are not guaranteed to be unique, legally protectable, cleared for commercial use, or accepted by an advertising platform. Review every output before using it, particularly in advertising, regulated industries, and depictions of identifiable people.
We do not guarantee advertising approval, engagement, revenue, conversion rates, or a particular creative result. Generation estimates are illustrations, not promises of a fixed number of usable assets.
4. Your inputs and outputs
Inputs are prompts, reference materials, uploads, and other content you submit. Outputs are content generated in response. Together they are your Content.
You retain your rights in Inputs. As between you and Supaviral, and to the extent allowed by law and applicable model licenses, you retain or receive the rights in your Outputs. To the extent Supaviral acquires transferable ownership rights in an Output, we assign those rights to you. This does not transfer another person’s rights, override provider restrictions, or guarantee copyright protection or exclusivity.
You may use Outputs for personal and commercial projects, including ads, subject to these Terms, applicable law, and any model-specific conditions disclosed for the feature. You are responsible for checking rights in brands, products, stock assets, music, characters, and people depicted in the final work. Built-in templates, example assets, catalog actors, and third-party materials are licensed resources, not an assignment of their underlying ownership or exclusive rights.
You confirm you have the rights, permissions, notices, and lawful basis needed to submit and process your Content, including consent where required for a person’s likeness or voice. Do not submit confidential material if you are not authorized to disclose it to the providers involved.
5. Permission to process Content
You grant Supaviral a non-exclusive, worldwide, royalty-free permission to host, store, reproduce, transmit, format, and process your Content only as reasonably needed to provide the Services you request, maintain security, respond to support requests, and comply with law. This includes allowing infrastructure and generation providers to perform those tasks.
This permission does not authorize us to sell your private Content, publish it in our marketing, or use it to train a general-purpose model ourselves. Any such separate use requires its own lawful permission. AI providers’ processing and retention practices vary as described in our Privacy Policy.
The service permission ends when Content is deleted, except to the extent reasonably necessary for restricted backup retention, legal obligations, security, or resolving existing claims. Copies you publish or give to others may remain outside our control.
6. Acceptable use
Use the Services lawfully and responsibly. You must not:
- Generate, upload, or distribute child sexual abuse material, sexualized depictions of minors, non-consensual intimate images, or content that exploits or endangers children.
- Use a person’s face, voice, identity, or likeness without necessary permissions, impersonate a person deceptively, or fabricate endorsements, testimonials, credentials, or evidence.
- Infringe intellectual property, privacy, publicity, or other rights; disclose someone’s sensitive information unlawfully; or use stolen or unauthorized materials.
- Create fraud, scams, phishing, deceptive advertising, unlawful discrimination, targeted harassment, threats, hate, or instructions that facilitate serious harm or crime.
- Mislead viewers about a product’s properties, a person’s real experience, or whether a material depiction is synthetic when disclosure is legally or contractually required.
- Attempt to bypass safeguards, manipulate credit accounting, evade limits or suspensions, probe unauthorized systems, distribute malicious code, or disrupt the Services.
- Use automated access that is not supported or authorized, extract other users’ data, or resell access to the Services without permission.
- Remove required provenance, copyright notices, or watermarks, or breach an applicable provider’s usage restrictions.
We may refuse a request, restrict a feature, remove Content, or suspend an account when reasonably necessary to address a violation, a security risk, or a legal requirement. We may investigate reports and preserve relevant evidence. Where appropriate and lawful, we will explain the action and provide a way to seek review.
7. Ads, likenesses, and disclosures
You are responsible for the ads you publish, including claims, substantiation, required disclosures, rights clearances, targeting, and compliance with the rules of the platform where they run. A fictional or AI-generated actor is not a real customer or independent endorser and must not be presented as having a genuine personal experience they did not have.
Obtain any required model releases and permissions for real people. Label synthetic or altered media when required by law or platform rules. Do not imply that a public figure, rights holder, Supaviral, or a model provider endorses your business without authorization. Supaviral is not affiliated with an advertising network merely because its tools can create ad assets.
8. Plans, payments, and renewals
Prices, currency, billing interval, included credits, and applicable taxes are shown on the pricing page or at checkout. The checkout summary governs your purchase. Payments are processed by Stripe. You authorize charges for the plan and interval you select and any applicable taxes.
Subscriptions renew automatically at the selected weekly or monthly interval unless canceled before renewal. Manage or cancel your subscription through Settings → Billing and the linked billing portal. Cancellation ordinarily stops the next renewal while access continues through the paid period, subject to the subscription status shown there. Contact us if you cannot access cancellation controls.
Deleting a browser app, stopping use, or revoking Google access does not cancel billing. Failed or overdue payments may result in restricted access. We will communicate material subscription price or billing changes before they apply, as required by law, so you can cancel before renewal. Changes do not retroactively increase a completed purchase.
9. Generation credits
Credits are a service usage allowance, not currency, stored value, or an investment. They have no cash redemption value and cannot be transferred or sold unless a feature expressly permits it. Different models and settings consume different amounts; estimates can change with duration, resolution, audio, and provider pricing.
Subscription credit allowances refresh for the paid billing period. Unused included credits do not roll over unless your offer expressly says otherwise. Credits may be reserved while a job runs and reconciled when the job completes or fails. Check your usage history and report unexpected charges so we can investigate.
A successfully processed request may consume credits even if its creative result is not what you hoped for. A failed or interrupted request is assessed using its actual provider and job status; we will correct erroneous credit deductions. Promotional credits and any separate credit purchases follow the conditions disclosed with the offer.
10. Refunds and consumer rights
Except where applicable law requires otherwise or a specific offer states otherwise, subscription fees are not refunded simply because you stop using the Services, have unused credits, or dislike an otherwise successfully generated result. Contact us about duplicate charges, billing errors, or a service that was not provided so we can investigate and offer an appropriate remedy.
Nothing in these Terms excludes mandatory cancellation rights, cooling-off rights, consumer guarantees, or remedies for defective or misdescribed services. Where immediate supply of digital content requires your express consent and acknowledgment that a withdrawal right will be lost, that must be obtained separately at purchase; accepting these Terms alone is not that consent.
If we discontinue a paid service without providing the contracted remainder or an acceptable alternative, you retain any right to an appropriate refund or other remedy under applicable law. Request a refund or billing review using the contact details below and include the relevant account and transaction reference, without full card details.
11. Third-party services
Authentication, payment, hosting, storage, and generation depend in part on third-party providers. Model-specific licenses and use restrictions may apply to the model or assets you select and do not grant the provider ownership of your whole Supaviral account. Review relevant conditions before using a model for restricted or sensitive work.
Providers can change availability, pricing, output behavior, or rules. We may replace or remove a model when necessary. External sites and services you choose to visit have their own terms and privacy notices. These dependencies do not remove obligations we owe you under mandatory law.
12. Supaviral’s intellectual property
Supaviral and its licensors retain rights in the software, interface, logos, branding, documentation, templates, and other materials we supply, excluding your Content. We grant you a limited, non-exclusive, non-transferable right to use the Services and supplied materials through the features and plan available to you.
Do not copy, redistribute, sublicense, or reverse engineer the Services except where we authorize it or applicable law permits it. Exporting a generated asset through an intended feature is permitted subject to the content terms above. If you submit feedback, we may use the suggestions to improve the product without payment or attribution, without disclosing your personal information contrary to our Privacy Policy.
13. Rights and abuse reports
If you believe Content infringes your rights or violates these Terms, contact us with your name and contact information, the location or identifiers of the material, a description of the rights or harm involved, and enough detail to investigate. Rights holders or authorized representatives should identify the original work or right and explain their authority.
Where a formal copyright notice process applies, include the required good-faith and accuracy statements and signature. We may request additional information, remove or restrict material, notify an affected user where appropriate, and act against repeat infringement. Do not submit knowingly false claims. We have not designated a statutory copyright agent through this page; any legally required designation must be made separately.
14. Suspension and account closure
You may stop using the Services at any time, cancel renewal through billing controls, and request account closure or deletion by contacting us. These are separate actions. Export work you want to keep before closing an account.
We may suspend or terminate access for material violations, fraud, serious security risks, legal requirements, or non-payment. Where reasonable and legally permitted, we will give notice and an opportunity to remedy a problem; urgent cases may require immediate action. Contact us to request review of a restriction.
Closure may make Content inaccessible. Retention and deletion are described in our Privacy Policy. Accrued payment obligations and provisions intended to survive, including content rights, legal limitations, and dispute handling, continue to apply. Any refund or consumer entitlement required by law remains available.
15. Availability and warranties
We aim to operate a useful and reliable service, but cannot promise uninterrupted access, error-free generations, permanent storage, or that every output suits your purpose. Subject to mandatory rights, the Services and outputs are provided as available, without additional implied warranties of merchantability, fitness for a particular purpose, or non-infringement to the extent those exclusions are lawful.
Maintain your own backups and review outputs before relying on them. Nothing here excludes a service standard, guarantee, or remedy that applicable law does not allow us to exclude.
16. Responsibility and liability
Each party remains responsible for its own conduct and obligations. To the extent permitted by law, Supaviral is not liable for indirect or consequential losses, such as lost profits, lost opportunities, or losses arising from your publication of unreviewed outputs.
For business customers, to the extent lawful, our total liability arising from the Services is limited to the fees you paid us for the Services in the 12 months before the event giving rise to the claim. This business limit does not apply to consumers.
These exclusions and limits do not apply to fraud, fraudulent misrepresentation, death or personal injury caused by negligence, deliberate misconduct, or any liability that cannot lawfully be excluded or limited. Consumers retain the remedies and compensation available under applicable mandatory law. You are responsible for claims arising from your unlawful Content or use; these Terms do not create a blanket consumer indemnity.
17. Resolving disagreements
Contact us first if there is a problem so we can try to resolve it informally. Describe the issue, the relevant account, and the outcome you seek. This does not prevent urgent court relief, a complaint to a regulator, or the exercise of a statutory right.
Applicable law determines the governing law and courts with jurisdiction. Consumers retain any mandatory protections and right to bring a claim in their home jurisdiction. These Terms do not require binding arbitration, waive class or collective rights, or restrict access to a court where the law provides it.
18. Changes and contact
We may update these Terms to reflect product, provider, or legal changes. We will update the date above and give appropriate advance notice of material changes. Where required, we will ask you to accept revised terms. Changes will not retroactively remove accrued rights. If you do not accept a change, you may stop using the Services and cancel future renewal, without losing mandatory remedies.
If part of these Terms is unenforceable, the remaining terms continue to apply where lawful. A delay in enforcing a right is not a waiver. We may transfer the agreement as part of a genuine business transfer if that does not reduce your mandatory rights; we will provide legally required notice. You may not transfer it without our agreement except as allowed by law.
